Terms of Sale

These terms apply to every commission from LovedCanvas ("the studio", "we"), whether ordered by a private customer or a trade customer. By confirming an order you accept them. Where a trade agreement specifies otherwise in writing, the trade agreement prevails.
1. Quotes and orders
Every commission starts with a written quote based on size, number of subjects, detail level, framing and shipping destination. A quote is valid for 30 days. An order is confirmed when you accept the quote in writing and pay the deposit. We may decline a commission at the quote stage, including for the reasons in our image rights policy.
2. Payment
A deposit of 50% is due to start painting; the balance is due after you approve the digital proof and before the painting ships. Prices are quoted in the currency stated on the quote. Import duties and taxes in the destination country are the recipient's responsibility.
3. Timeframes
We confirm an estimated timeframe on each order. Estimates are given in good faith and are not guaranteed: painting, drying, varnishing and transit times vary, and customs clearance is outside our control. If a deadline matters, tell us before confirming and we will say whether it is realistic. We will tell you promptly if an order is running late.
4. The digital proof
Before any painting ships, we send you photographs of the finished painting (straight on and under raking light) for approval. Approval in writing — an email or a message — is required before varnishing, framing and shipping. If you do not respond to a proof within 14 days we will send reminders; the order remains open until you approve.
5. Revisions
Adjustments requested at the proof stage that stay within the original brief — likeness, colour, background tone, small details — are included in the price and are made until you approve. Changes to the brief itself — a different reference photo, an additional subject, a change of size or detail level, or a substantially different background — are quoted separately before work continues.
6. Refunds and cancellation
- Cancellation before painting starts: full refund of the deposit.
- Cancellation after painting starts and before the proof: the deposit is retained to cover work done; no further payment is due.
- After proof approval: because the painting is custom-made to your brief and approved by you, it cannot be returned or refunded for change of mind.
- If we cannot deliver a painting that meets the brief — for example, if the reference photographs turn out not to support the agreed detail level and no alternative is possible — we refund in full.
7. Shipping and transit damage
Paintings are packed as described on our shipping and packaging page and shipped with tracking. Risk passes to you on delivery. If a painting arrives damaged, photograph the outer packaging and the painting before doing anything else and contact us within 48 hours of delivery; we will repair, repaint or replace at our cost and handle the carrier claim. Claims made after 48 hours or without photographs may not be accepted by the carrier's insurer, and we cannot guarantee cover in that case.
8. Trade customers
- Trade pricing is available to businesses from the first piece, with no minimum order, on request and at our discretion.
- Trade orders ship unbranded: no studio branding on the painting, the packaging or the paperwork. We include your card or certificate if you supply it.
- We ship directly to your customer on request. Tracking is sent to you. We do not contact your customer.
- You may resell paintings commissioned from us under your own name without restriction and may use photographs of them in your marketing. You may use our portfolio and process images in your marketing while your account is active, with attribution not required.
- We do not publish paintings made for trade customers without your written permission.
- Trade price lists are confidential and may not be published.
9. Image rights
Our image rights policy forms part of these terms. In summary: you confirm that you have the right to the reference photographs you supply; and unless you opt out, we may photograph the finished painting to show our work, never publishing your reference photographs, name or details.
10. Limitation and law
Our liability for any order is limited to the price paid for that order. Nothing in these terms limits liability that cannot be limited by law. These terms are governed by the laws of Shenzhen, China.
